Full Terms & Conditions

 1.     By taking part in this Promotion you (“the Participant”, “you”, “your”) confirm that you accept these terms and conditions and confirm that all information submitted is true, accurate, and complete. Participants shall at all times act in good faith towards the Promoter and the Promotion.

2.     This Promotion is open to customers who purchase a Participating Pack during the Purchase Period and otherwise meet the conditions of these Terms & Conditions, subject to the following:

a.    The Participant must be a resident of the United Kingdom (excluding the Channel Islands and the Isle of Man),;

b.    The Participant must be aged 18 or over;

c.     The Participant must not be an employee of the Promoter, its agents, affiliates or be professionally associated with this Promotion.

3.     Promotion Period:

a.    Purchase Period: Purchase must be made between 12:00 BST on the 1 September 2024 and 23:59 GMT on the 30 November 2024 inclusive.

b.    Participation Period: You must submit a claim within 90 days from the date of your purchase.

 4.     Purchase is necessary. Please retain an itemised receipt that states the time and date of purchase prior to claim, but within the Purchase Period, as this will be required for claiming and in order to receive a Refund. Internet access, email address and a valid UK bank account are required.

5.     To Claim:

a.    Purchase a Participating Pack (as set out below) of Scholl GelActiv Insoles (up to a maximum value of £16.99) during the Purchase Period. See Clause 5 for a list of Participating Packs.

b.    Use as per back of pack instructions.

c.     If you are not happy with the Insoles, within 90 days from the date of purchase:

                                               i.     Visit www.gelactivmbg.co.uk and complete the online form. You must provide your personal details (full name, postcode, bank account details and email address), upload a photo of your receipt along with the reason why you did not like the product (minimum of 15 words) and click “Submit”; and

                                              ii.     Send your Insoles, along with your full name, postcode and email address to the postal address displayed on screen to claim your Refund.

6.     Further Claim Details:

a.    Claims or Insoles received after 90 days from the date of purchase will be disqualified.

c.     Moderation: The Promoter reserves the right to reject claims which, in the reasonable opinion of the Promoter:

                                               i.     are in breach of these Terms & Conditions;

                                              ii.     contain any content that is offensive, harmful, objectionable or which is otherwise unsuitable for publication including with respect to race, religion, origin or gender, or which could reflect negatively upon the name, reputation or goodwill of the Promoter or any brand partner;

                                             iii.     contains or refers to any unauthorised third-party brand or reference any third-party names, logos and/or trademarks;

                                             iv.     promotes any political agenda.

d.    Claimants must provide a valid reason for their dislike of the product, adhere to the Terms & Conditions and send their product back to the address presented on screen for their claim to be deemed valid.

e.     Assessment of the validity of the claim shall be at the discretion of the Promotor and shall be final and binding.

7.     Maximum of 1 claim is permitted per person during the Participation Period. One itemised receipt per claim must state the time and date of purchase, which must pre-date the claim date and time, but be within the Participation Period.

8.     The Refund: Each valid claimant will receive 1 x cash back to the value of the Insoles as itemised on the receipt.  Postage and any other costs will not be refunded.

 9.     Further Refund Details and Conditions:

a.    The valid claimants will receive their Refund via BACS to the bank account provided upon claiming.

b.    Participants are responsible for providing correct bank account details and the Promoter will not be liable for any Refund payments made into the wrong bank account.

c.     If a customer purchased a discounted pack, they will receive a refund on the discounted value of the pack only.

10.  Refund Claiming: Any claims received that do not meet these requirements or are received after the Participation Period will be void and invalid.

11.  Refund Notification: Participants will be contacted via the email address provided upon claiming within 14 days of their claim and will be asked to provide evidence of identity and eligibility. Reasonable efforts will be made to contact the claimants. Once identity and eligibility has been confirmed, the claim will be confirmed as valid.

12.  Refund Acceptance: Fulfilment of a Refund will take place within 28 days of Refund Notification. In the unlikely event that a Refund does not arrive within 28 days, the claimant must inform the Promoter by emailing gelactivmbg@responsehandlingteam.co.uk. If a claimant does not do so, the Promoter reserves the right to not reissue the Refund or limit its value at its sole discretion.

13.  The Promoter may request that the valid claimants participate in publicity arising from the Promotion. Participation is at the claimant’s discretion and is not a condition of Refund Claiming.

14.  The Promoter seeks to run a fair and secure promotion and prevent abuse and cheating. If you enter in a way that is not consistent with these Terms & Conditions, your claim (and any of your associated aliases) will be disqualified. Any Refund awarded may be void and recoverable, and the Promoter reserves the right to bar you from entering future promotions for a period of at least six months. For this reason, the Promoter reserves the right at any point to:

a.    Verify the eligibility of claimants through multiple means by requesting such information it consider reasonably necessary for this purpose. Refund may be withheld until verification is completed.

b.    Disqualify claims that are not made directly by the individual entering the Promotion.

 c.     Disqualify claims made using anonymous email services such as, but not limited to, GuerillaMail, Dispostable or Mailinator.

d.    Disqualify bulk claims from individuals, trade, consumer groups or third parties, incomplete claims and claims submitted by macros or other automated means.

e.     Disqualify claims beyond the maximum allowed, or those using techniques such as ‘script’, ‘brute force’, masking identity by manipulating IP addresses, using aliases or identities other than their own or any other means.

f.      Disqualify claimants who tamper with the entry process.

g.    Disqualify claimants which, in some other way, do not meet the requirements of these Terms & Conditions.

h.     Cancel, modify or suspend the Promotion should it not be capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion.

15.  The Refunds are not transferable or exchangeable and cannot be redeemed for any other form of compensation.

16.  No responsibility can be taken for claims which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. The Promoter does not guarantee continuous or secure access to the microsite.

17.  The Promotor does not assume any responsibility for any typographical or other error in the administration of the Promotion. Additionally, the Promotor is not liable for the reproduction of this offer or indirect access via third party websites of these Terms & Conditions and where such reproduction misstates or omits any of the information or terms and conditions connected with this Promotion.

18.  The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using the/a Refund(s), except for any liability which cannot be excluded by law.  Nothing will exclude the Promotor’s liability for death or personal injury as a result of its negligence.

19.  The Promoter will not be liable for any delay or failure to comply with its obligations for reasons beyond its reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances.

20.  All personal data supplied for this Promotion will be used for the purpose of this Promotion and for research and analytical purposes by the Promoter and/or by any agent appointed by it to assist with running the Promotion. Personal data will not be disclosed to an unconnected third party unless your positive consent has been obtained. Your personal data will be handled in accordance with the Promoter’s privacy policy, available at: www.scholl.co.uk/pages/privacy-policy.

21.  If any part/s of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.

22.  By claiming, you will be deemed to have agreed to be bound by these Terms & Conditions.

23.  If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.

24.  These Terms & Conditions are governed by English law and their interpretation and application will be subject to the non-exclusive jurisdiction of the courts of England and Wales. Residents of Scotland and Northern Ireland may bring proceedings in their own jurisdiction.
